במהלך המשפט הציגו התובעים טענות שונות ומשונות במגוון נושאים הבוערים על הפרק. השופט, דחה בהינף יד את רוב הטענות וקיבל חד משמעית את עמדת המל"ח. את הנושא המרכזי, הבעלות על '770' דחה בשבועיים עד ליום ההילולא כ"ד טבת, כיון שהצד התובע 'טען לפתע' כי אינו מוכן די צורכו. בימים האחרונים, התפרסמו מעל גבי אתרי אינטרנט שונים ובימות מפוקפקות, מאמרי התקפה חסרי רסן נגד חברי אגו"ח והמל"ח. כמו כן, התפרסם בראש חוצות מאמר שטנה מזוויע מלא בדברי לעג וקלס כלפי הוד כ"ק אדמו"ר זי"ע, כלפי השלוחים שיחיו ברחבי תבל, כלפי מזכיריו של הרבי ושאר הרה"ח שבחר הרבי להעמיד בראש מוסדותיו הק'. מערכת COL בארה"ב, נמנעה עד כה מלפרסם את דבר קיום המשפט, התביעה המבישה, ומה שהתחולל סביבה משום "כבוד אלוקים הסתר דבר" [משלי כ"ה] אולם משרבו ההשמצות, וגדלו התקפות השנאה המזעזעות, החלטנו לקיים את חלקו השני של הפסוק "וכבוד מלכים חקר דבר", ולכבודו של הרבי הננו מפרסמים מנשר שהוציאה היום קבוצת שלוחים שכבר לא יכלו להתאפק עוד, אל מול ההרס והחורבן המתחולל בידי קבוצת אנ"ש ותמימים קיצונית ושולית, ואין פוצה פה ומצפצף. בתקווה שיתמו חטאים, וכבודו של הרבי ושלוחיו יפסיק להרמס בתוך אנ"ש ובעיקר בראש חוצות.

To All Chassidim, Shluchim and the community of
In response to many inquiries concerning the events relating to the plaque
surrounding the cornerstone at 770, we hereby present a brief outline of the facts.
We are saddened that it needs to be done publicly, but we are compelled to do so in
the hope of preventing any further confusion or misinformation.
Following Gimmel Tammuz
and bizarre behavior, managed by force and intimidation to dominate and control the
downstairs shul in Bais Agudas Chassidei Chabad - 770. Since that time the situation
in the Shul has been deteriorating steadily. The Shul has been transformed from a
place to which thousands of Chassidim, Yidden, parents and children, Shluchim and
visitors would come; a place of Torah and Chassidus, a place of Davening, learning,
inspiration and Farbrengen – into a place of anarchy, dominated by violent and
unruly individuals. Those who are not in complete accord with their preferences – be
they venerable Rabbonim, campers, youngsters of Tzeirei HaShluchim or anyone else
– are threatened, assaulted and even forcibly ejected.
Sadly, it has come to a point that a great number of Anash and Shluchim avoid
coming into the shul in 770 altogether.
Throughout this entire period, Lubavitch Headquarters received countless pleas from
Anash and Shluchim requesting that it act decisively to put a stop to the anarchy
that has prevailed, and to restore order to 770. Nevertheless, for the longest period
of time, they opted for a path of restraint and refrained from taking any strong
Even after the recent events, when it became absolutely imperative to take action to
prevent further deterioration in 770, Merkos continued to act with restraint, as is
evident from the following description of events:

Upon completion of the plaza at
erected around the stone which was used by the Rebbe יז " ע during the cornerstone
laying ceremony for the expansion of 770. Appropriately, the plaque made reference
to the Rebbe with the traditional acronyms, as required by Halacha and in
accordance with Jewish custom, and as the Rebbe instructed when referring to the
Shamefully, before long, the plaque was defaced by individuals who apparently took
issue with the titles ascribed to the Rebbe’s name. Nevertheless, for nearly a decade,
nothing was done.
Recently, this group of individuals decided that this was not sufficient for them.
Under cover of darkness, they removed the plaque, attempting to replace it with one
that was more to their liking. By Divine Providence, during the act they were seen by
the very persons who were appointed by the Rebbe to direct Agudas Chassidei
Chabad and Merkos L’Inyone Chinuch. They hastened to summon the police. After
taking note of the damage that was done, the police proceeded to question those
present and arrested several of the perpetrators.
As stated, the police were summoned for the purpose of preventing further damage
to 770. This would be expected of any person hoping to prevent further damage to
one’s home or property. After further investigation the police arrested several more
of the individuals.
Since the original plaque had been stolen, a new plaque was made, identical to the
original. In an effort to ensure that the installation of the plaque would take place
peacefully and without interference, Merkos asked the NYPD to be present.
Merkos had no choice but to request a Restraining Order from the Court, forbidding
any interference with the installation of the plaque. This order, in turn, required the
NYPD to be present to protect the installation.
Unfortunately, some members of the Shchunah worked to prevent the presence of
the NYPD, who would make certain the installation occurred without incident. They
needlessly injected themselves into the controversy – and then attempted to install
yet a third plaque, whose language was to their own liking – omitting any reference
to the Rebbe whatsoever.
Indeed, as the installation of the proper plaque finally got under way, the police
announced that there was a Court Order restraining anyone from interfering with the
installation, and that anyone who would violate the order would be arrested. While
the majority of those present left the area, a few of them remained behind. Knowing
full well that they would be arrested, they continued to obstruct the installation. This
clearly did not happen spontaneously and without foreknowledge. It was their
deliberate intention to get themselves arrested, and to then falsely claim that
“Merkos had them arrested.”
Following the installation of the plaque, most of the police officers departed the
scene. At that point, wanting to make certain that the matter would not pass quietly,
a group of individuals emerged from 770 and attempted to forcibly remove the newly
installed plaque. When the remaining police officers prevented them from doing so,
they scuffled with the police, who called for reinforcements. Needless to say, the
police arrested several of the violators.
In summation: Throughout this saga Merkos and its supporters never chas v’shalom
lifted a hand against anyone. All Merkos set out to do was to ensure that a
plaque, identical to the original plaque which had been erected ten years
earlier, which had been defaced and then stolen, could be installed.

By contrast, the behavior exhibited by these individuals was most reckless:
Destruction and theft of property, interfering with the installation of the replacement
plaque knowing it would lead to arrest, and finally, fighting with police officers!
We must clarify that there is no basis whatsoever for the claim that Merkos’ actions
were those of one, or several, individuals, acting unilaterally. Every step that was
taken in this matter was in accordance with a majority decision by Merkos’ Board of
There are no grounds whatsoever to the charge that Merkos acted excessively or
with unnecessary force. The very opposite is true. Merkos was exceptionally patient
and has refrained from any strong action, taking great pains to keep the peace.
Alas, these individuals willed otherwise.
We are certain that Merkos will continue to fulfill its mandate and its responsibility, in
consultation with Rabbonim - and in accordance with the instructions of the Rebbe –
particularly, the governing documents which were approved and signed by the Rebbe

that the Rebbe’s Shul is restored to its former glory, a place where all Chassidim will
once again come together with ahavah and true achdus, giving nachas to the Rebbe
until the coming of Moshiach.
