נצחון ביניים בבג"ץ בדרך למינוי הרב דיסקין לרב קרית אתא
כזכור הגישו שני תושבים מקרית אתא לפני כשלושה שבועות עתירה לבג"צ נגד הרבנות הראשית לישראל והשר יעקב מרגי כי יחלו בהליך לבחירתם של שני רבני עיר לקרית אתא.
המטרה: לאפשר לשליח חב"ד הרב חיים שלמה דיסקין - המתפקד למעשה בכל המובנים כרב העיר בפועל ושל תושבים רבים מכל החוגים והעדות - להיבחר רשמית לרבה של קרית אתא. את תושבי העיר מייצגת עו"ד נחמה ציבין.
לאחר הגשת העתירה הורתה שופטת בית משפט העליון, הגב' איילה פרוקצ'יה לשר ולרבנות הראשית להשיב לעתירה בתוך 10 ימים. החלטה כזו למתן תגובה בזמן כה קצר מלמדת כי בית המשפט מייחס חשיבות לעתירה זו. מחלקת הבג"צים בפרקליטות המדינה, האמורה להשיב בשם השר והרבנות הראשית, בקשה ליתן לה ארכה במתן תשובתם לבג"צ. כפי שהעריכו יודעי דבר, תתקשה המדינה והמשרד לשירותי דת להציג בפני בג"צ קריטריונים שוויוניים לאיפיון הערים בהם יבחרו שני רבנים ובאילו ייבחר רב יחיד.
ממקורות מוסמכים נמסר, כי עתירה זו מסבה כאב ראש לא מבוטל לשר מרגי החפץ באופן עקרוני למנות ברחבי ישראל, זוגות של רבני ערים לעתיד לבוא, אלא שבקרית אתא השיקולים הפוליטיים הצרים גברו.
כאמור הגישה הפרקליטות בקשה לארכה לשם הגשת תשובתה כשהיא מודיעה, כי כל עוד לא הגישה תשובתה לא תקבע ועדת הבחירות לרב עיר בקרית אתא, מועד לקיום הבחירות. בכך סיכלה הגשת העתירה ביצוע מחטף ע"י גורמים פוליטיים ואינטרסנטיים לקיים את הבחירות ביום ח' בניסן תש"ע, דבר אשר היה מונע מהרב דיסקין להגיש מועמדות.
עו"ד מרדכי איזנברג יו"ר התנועה להגינות שלטונית אמר לכתבנו כי, כבר עם הגשת העתירה בידי עו"ד נחמה ציבין העריכו רבים כי המדובר למעשה בעתירה שתסדיר את סוגיית הקריטריונים למינוי שני רבני עיר בישראל.
עו"ד נחמה ציבין המייצגת את העותרים אמרה כי, הכל מצפים לתשובת המשרד לשירותי דת אשר אמור להציג את נהלי עבודתו והחלטותיו בכל הקשור לבחירות רבני עיר בערי ישראל ובינתיים יש לברך על עצירת ההליך למינוי רב עיר יחיד לקרית אתא. "קביעת קריטריונים למינוי שני רבני עיר, אשכנזי וספרדי, תגרום בין היתר כי האפליה נגד רבנים ושלוחים של חב"ד בערים רבות בישראל, תיפסק".
Interim victory in baga"tz for the appointing of Rabbi Diskin to be the Chief Rabbi of Kiryat Ata
Three weeks ago, two citizens of Kiryat Ata filed a petition to baga"tz against the Chief Rabbinate of Israel and Minister Ya'akov Margi to require them to begin the process for choosing two Chief Rabbis for the city of Kiryat Ata. The goal: enabling chabad shliach, Rabbi Chaim Shlomo Diskin - who in effect acts in all respects as the Chief Rabbi of the city and of many of its residents from all circles and ethnicities - to be officially nominated as the Rabbi of Kiryat Ata. The cities residents are represented by attorney Nechama Tzivin.
After the petition was filed Supreme Court Judge, Mrs. Ayla Prokachya, ordered the Minister and the Chief Rabbinate to reply to the petition within 10 days. Such a decision ordering a reply within such a short time teaches that the court attributes importance to this petition. The baga”tz department in the attorney general, who is supposed to reply in the name of the Minister and the Chief Rabbinate, requested an extension of time for supplying their reply to baga”tz. As estimated by knowledgeable sources, the State and the Ministry for religious services will find it difficult to present before baga”tz equal criterions for the characterization of cities in which two Rabbis will be appointed and cities in which only one will be appointed.
Knowledgeable sources also say that such a petition is a big headache for Minister Margi who in principle wishes to appoint in the future two Rabbis for each city, but in Kirayt Ata narrow political considerations took over.
As mentioned, the attorney general requested an extension for handing her reply when announcing the until the reply is submitted, the electoral committee for the Chief Rabbi of Kiryat Aata shall not set a date for the elections. By this, the filing of the petition disrupted an underhanded opportunism by political factors and other people with interest to hold the election on ches nisan tash”a, which whould have denied Rabbi Diskin to be a candidate.
Attorney Mordechai Eizenberg, head of the movement for fairness in Government, said to our reporter that with the filing of the petition by attorney Nechama Tzivin many estimated that in essence this petition will regulate the issue of criterions for appointing two rabbis for each city.
Attorney Nechama Tzivin who represents the petitioners said that all are expecting the reply of the Ministry for religious services, which is supposed to present its practices and decisions regarding all related to the elections of Chief Rabbis of Israeli cities and in the meanwhile the halt put to the appointing of one Rabbi to the city of Kiryat Ata is blessed. “The decision upon the criterions for appointing two Rabbis, Aahkenzi and Sfardi, will cause, among others, that the discrimination against Chabad Rabbis and Shluchim in many cities in Israel, will stop”.
