לא ידעתי עם מי הצדק אבל כשראיתי את ההתקפה הישירה על הר סגל שלדעתי הוא אחד הרבנים היחידים בחב"ד שאפשר לבטוח בו שיוציא משפט צדק ולמולו חותם על המכתב הר בוגומילסקי שיצא לו שם להיפך אני יודע עם מי הצדק

אף אחד אינו צריך לבוחרם ברבני השכונה. הנ"ל הם רבנים שקראו לדין תורה את סגל אז מה עם הם אינם חברי הבי"ד.
בשעה שמי שנק רב שמקבל הזמנה מג רבנים, עליו להשיב להרבנים, ולבוא לדי"ת או לזבל"א, ולא להתחצף וכו.

גם הצד של הרב אזדאבא שהרבי אמר עליו אביר שבאבירים שכן מחזיק מבחירות אלו

משה רובשקין מספר שבשנת תשמ"ו הרבי הורה לרבנים מארלאוו ואוזדובה שלא להתערב מי יהיה מועמד לרב שלישי. אנו שואלים:

1) רוב ההוראות של הרבי בנושאים אלו היו בכתב. מדוע אין הרב רובשקין מפרסם את נוסח התשובה, כדי שכולם יוכלו לראות שהוא דובר אמת?

2) כולם יודעים שבבחירות של שנת תשס"ג הרב אזדובה הוא זה שהחליט מי יהיה מועמד. לפי מה שמספר היום רובשקין, שהרב אוזדובה (ביחד עם הרב מארלאוו) קיבל מהרבי הוראה שלא להתערב בזה, נמצא שהרב אוזדובה פעל בשנת תשס"ג להיפך מהוראה שהוא קיבל מהרבי בשנת תשמ"ו!

3) אם מה שרובשקין מספר אינו נכון – וכך נראה הדבר, עד שרובשקין יוכיח את דבריו באמצעות נוסח הוראת הרבי – הרי שהוא מפרסם היום דברי בלע כנגד הרב אוזדובה שפעל להיפך מהוראת הרבי! לא די לו לרובשקין במה שפרסם מכתב מחוצף בו הודיע שלדעתו מעמדו של הרב שוויי כרב בשכונה מוטל בספק, עכשיו הוא עושה זאת גם לרב אוזדובה, כשהוא מפרסם שהרב אוזדובה התכחש להוראה שהוא בעצמו קיבל מהרבי!

4) רובשקין השתמש בכספי ציבור כדי להדפיס קונטרס יקר שבו כ-70 עמודים רצופים בטענות מטענות שונות. על שער הקונטרס הדפיס רובשקין דברים שאמר הרבי בשיחת שבת פרשת מטות-מסעי תשמ"ו במעלת הבחירות שהיו אז. רובשקין לא טרח לציין איפה נדפסה השיחה, ובסידרה הרגילה של ספרי השיחות היא לא נמצאת, בגלל הביטויים החריפים שהיו בה. אבל הדברים ידועים, ומה שמפתיע – ואולי אינו מפתיע? – שרובשקין בחר לעצמו לפרסם רק קטע אחד מתוך השיחה, והתעלם מן האמור בתחילתה. מובא כאן קטע מהשיחה, כפי שנרשם אז על ידי "ועד הנחות בלשון הקודש":

ישנם כאלו שהחליטו, משום-מה, שהם הבעה"ב בשכונה זו, והם אלו שצריכים למשול ולשלוט על הציבור כולו.

ולדוגמא: כשצריכים לבחור רב לשכונה – הרי הוא, ביחד עם חבריו, הם אלו שיקבעו ויחליטו מיהו המתאים לכהן בתור רב, והם ימנוהו לרב.

לא נשמע דבר כזה בישראל – ש"עסקן", או כמה "עסקנים", יחליטו על דעת עצמם על בחירת רב.

כשבחרו רב בקהילות ישראל – החליטו רבנים, גדולים בתורה וכו, מי הם המועמדים המתאימים לכהונת רב, ולא "עסקנים", אפילו "עסקנים" שיש להם סמיכה לרבנות, שכן, ידוע מ"ש הסמ"ע שדעת בעה"ב היפך דעת תורה, וכמדובר כמ"פ שהכוונה היא לבעה"ב שיש להם סמיכה לרבנות, שהרי בנוגע לבעה"ב סתם שאין להם סמיכה לרבנות – מאי קמ"ל.

עד כאן מהשיחה.

כל אחד יכול לראות שמה שעושה היום רובשקין, כשהוא החליט בעצמו מי יהיה המועמד לרב, הוא להיפך מהוראה ברורה של הרבי, שמצא לנכון להתריע ברבים מול תופעה זו!

5) לפני הבחירות של שנת תשס"ג פסק הרב אוזדובה, שעל המועמד לרבנות, הרב שוויי, לקבל קולות של רוב תושבי השכונה. בשכונה התגוררו אז כ-1600 משפחות, וכדי להבחר היה צריך הרב שוויי לקבל לפחות 800 קולות. לפי הפסק של הרב אוזדובה אז, נמצא שכל אלה שלא באו להשתתף בבחירות, מאיזו סיבה שלא תהיה – כולל אם שהו בתקופת הבחירות מעבר לים – נחשב קולם כאילו הצביעו נגד בחירת המועמד. לפועל, קיבל הרב שוויי קרוב ל-1000 קולות, שזה רוב גדול מתושבי השכונה.

היום, אחרי שהשכונה גדלה והתפתחה ונוספו בה עוד משפחות רבות, מפרסם רובשקין שדי למועמדים – אלו שרובשקין קבע שהם מועמדים – אם יקבלו רוב מאלו שיביאו להצביע. במילים אחרות, אם יבואו להצביע רק 10 אנשים, די למועמדי רובשקין לקבל 6 קולות כדי להיות רבנים.

כיצד זה התיר לעצמו רובשקין לנהוג היום שלא כפי הפסק של הרב אוזדובה בשנת תשס"ג? האם התורה משתנה לפי הנסיבות?

6) עד לרגע בו נכתבות שורות אלו, יום חמישי ערב ראש חודש אייר, לא קבלו תושבי השכונה אף מכתב שיגלה להם מי הם המועמדים של רובשקין. רובשקין שומר זאת בסוד עד לרגע האחרון. לכן, גם מבלי להכנס לשאלה ההלכתית של כשרות הבחירות הללו (וכאמור, ישנו פסק של שלושה רבנים הקובע שאין לבחירות אלו כל תוקף), שואל את עצמו כל תושב הגון: האם אלה הם בחירות דמוקרטיות?

7) כולם רוצים בחיזוק הבד"צ וכולם רוצים שלום. אך אי אפשר לקחת את המילה "שלום", ולהשתמש בה בצורה הפכית (כפי שעושים – להבדיל – אוייבי ארצנו הקדושה). את המחלוקת יש לסיים פעם אחת ולתמיד בדרך תורנית, כלומר, בדין תורה, ולאחר מכן, כשיהיה שלום אמיתי, ניתן יהיה לחזק את הבד"צ באמצעות בחירות.

תושב קראון-הייטב שכואב.

אבל ב"בחירות" של משה רובאשקין יש רק מומעדים מצד אחד!!!
ואין זה בחירות!!!

בחירות ורק צד אחד מתמודד!!!

כולם רוצים בחירוצ - בפרינציפ - אבל כל אחד שרואה, ולא במקצת, מה שקורה בשכונת המלך רואה שאלו שמארגנים את הבחירות עושים א"ז תוך התעלמות טוטלי של רצון תושבי השכונה! ולא נעשה כלל באופן שקוף - אין לאף אחד (חוץ מ"ראש הקהל") שום דיעה בהנעשה - כולל מי הם המועמדים וכדו.
זה חוצפה בושה וחרפה!!! בחירות זה דרך לבדוק את רצון ה"עם" - אם "קודם" הבחירות - חלק גדול מתושבי הקהילה מאמינה שזה מאורגן באופן רע - בלי יושר - איך יכולים לקבל את תוצאות בחירות כזה?
הגיע הזמן שבחירות יאורגו (לא רק ביום הבחירות אלא גם כל ההכנות לזה) ע"י אנשים בלתי מעורבים או עכ"פ ע"י וועד מורחב - הכולל "כל" הצדדים - וכולם יחד יבוא למסקנה ע"י "רוב" - ורק אח"כ יעשו בחירות....
(אבל כנראה ש"אין דער היים" (= רוסיה הצארית/קומוניסטית) לא נהגו כך...... חבל מאוד. משיח נאו!

למה לא ללכת לדין תורה ולגמור הכל בדרך של שלום?

כן הזמינו את הרב סגל בזבל"א!!!

I never believed there would come a day when I would have to take pen to paper and share my thoughts about the matzev in Crown Heights. But as a simple chossid of the Rebbe I have an achrayus to now speak up and say what has to be said, and put into words what thousands of Anash know in their hearts and are thinking to themselves.

It is sad that I cannot use my real name. But there is terror in our kehillah, and gangsters are attempting to hijack our Beis Din and destroy the Rebbe’s community. I live in fear for my mishpoche, and must protect my identity.

Several years ago a sham election took place that was rigged by these gangsters. Like, lehavdil, in Stalin’s Russia or Saddam Hussein’s Iraq, only one candidate was listed because the other, more worthy Rabbonim, were terrorized into remaining off the ballot.

Worse yet, the sole candidate we were offered, Rav Schwei, had for two years been on the private payroll of a local Gvir, which by definition rendered him unfit to serve as Kehilla Dayan as he was already in at least one man’s pocket.

Rav Osdobo was terrorized into allowing this transparent corruption to go forward. However, he was able to set one condition – that two choshuve and experienced Rabbonim – Rav Raitport and Rav Segal – would serve as Dayanim alongside himself and Rav Schwei.

Rav Schwei accepted these terms at the time and then reneged on them once he was on the Beis Din. This alone should invalidate him as a Dayan lemafreia and force him, at the very least, to run once again, this time in a legitimate, non-Stalinist election.

Of course, the likelihood is that he would lose just as he would have lost the last time had he been running against Rav Raitport and/or Rav Segal.

Ever since he became a Dayan, Rav Schwei has been engaged in the relentless pursuit of power for himself and his backers. He has thwarted every majority psak, paskened against the Beis Din, gone public with every machloikes.

But the zenith of the chutzpah and azus metzach of this rogue dayan was his attempt to call his senior Moro D’Asro Rav Osdobo – a man with two decades of “shimush”, a Dayan who received the Rebbe’s brocho – to a Din Torah zablo with the signatures of one disgruntled Rov and one outright oisvorf from New Jersey. This is a chutzpah that has no precedent.

The truth is Rav Schwei does not belong on this or any Beis Din. He has disqualified himself by taking payment from private individuals and by working for a gang of criminals who have their own agenda.

During his three years on the Beis Din, Rav Schwei, under the directions from his handlers, has been engaged in a scorched earth policy to destroy every single vestige of credibility and functionality of the Beis Din.

He has generated non-stop machloikes and is directly responsible for the terrible state of our young people and the rampant lack of sholom bayis among many families in our schunah.

One need only compare the writings of Rav Osdoba and, Rav Schwei. Rav Osdoba backs every sentence, every statement with precise mar’eh mkoimos. Rav Schwei’s letters, his issurim, his denying us the right to vote have no sources, no precedent, and show no evidence of having any basis other than his personal opinion and personal agenda.

It is time to pull the camouflage off this situation and call it as it is.

The only solution is to vote for new Dayonim who can help Rav Osdobo restore honor and integrity to the Beis Din he helped create and run with such a sterling reputation for so long.

And we as a Kehilla must beg mechilleh from Rav Osdobo for standing silently while his shem tov was dragged in the mud, and for standing by while he and Rav Segal and Rav Raitport were subjected to such relentless and disgusting behavior.

A Chossid of the Rebbe

Even though I am of the opinion that we need more Rabbonim to solidify the Badatz, I cant help but agree fully with Rabbi Schwei that these election are illegal. It is hallachically prohibited to force a person to become a partner in an entity where the candidate is his nemesis. Unfortunately, those trying to force this election are motivated by greed and revenge. I believe that the overwhelming majority of Anash will boycott this election. The community was not timely apprised of the nature of the candidates and was not given ample time to digest all the pros and cons of the candidate etc. I also believe that some of the candidates come with baggage that may disqualify the from running in the election according to the by-laws which where written up with the approval of the Rebbe.

2. There are some individuals that decided, for some reason, that they are the owners of this schunoh and they are the ones that need to govern and control the entire community.

For example: When there is a need to elect a Rov to the schunoh – he, together with his friends are the ones that will establish and decide who is suitable to serve as Rov, and they will appoint him as Rov.

It is unheard of such thing in Israel [Jewish Nation] – that an “askon” (activist) or few “askonim” (activists) will decide on their own on electing a Rov.

When they elected a Rov in Jewish Kehilos – Rabbonim, Torah Gedolim etc., decided who are the suitable candidates to serve as Rov, and not “askonim”, even “askonim” that have smichoh (Rabbinical ordination) to be a Rov, because it is known what the ñî"ò writes that the opinion of áòä"á (laymen) is the contrary of the opinion of Torah, and like it was mentioned many times, that this, refers toáòä"á (laymen) that have smichoh to be a Rov because if it refers to people that do not have smichoh it will not be necessary to mention it, it will be self understood.

Even more so, when this “askon” announces openly - (after trying to speak quietly behind the scenes, and did not help) – that if his candidate for Rov will be elected, then he will give money etc., and if not he will not give … and through this he wants to force on the entire community his opinions – there is no bigger shochad (bribe) then this!

Such monies, given for the so called benefit of the community, with the condition that they should do as per the will of the one that gives the money – are not even from “klipas nogah” … (and definitely, they are not from Kedushoh), therefore, it is forbidden to use this monies for Kedusha matters!

No one will force his opinion on the community for a monetary bribe! You don’t want to give money (only if they will accept your authority) – do not do any favors, your money is not needed, because, “By Me is the silver and by Me is the gold says Hashem” …

The wonder is – how he is not ashamed to say openly that if they will elect his Rov, then he will support the Rabbinical establishment, when everyone sees that this is a matter of “shochad” (bribe) in the most severe way!

There is a letter from Rabbi Osdoba from the 29 of Chesvon 5766 where he clearly writtes:

... you should know that the elections for the new Rov had to have my approval ...

Also he writtes there:

... like in the first elections that each candidate needed approval from other Rabbonim that he is appropiate for it ....

1. ARE THIS ELECTIONS APPROVED BY ALL MEMBERS OF THE BADATZ?
2. WHICH RABBONIM APPROVED THESE CANDIDATES?
3. IS RABBI REITPORT MOVING INTO CH?
4. CAN WE SEE A WRITTEN CONSENT FROM ALL THE CANDIDATES THAT THEY ARE ACTUALLY RUNNING

Last time, when we had elections, to Elect Rabbi Schwei, then, Rabbi Osdoba was not only "Invloved" but was Invloved in all Deatils and he then claimed you need 80% of ELLIGBLE VOTERS (not 80% of actual votes) to vote for Rabbi Schwei, for him to win.

In the end, to Rabbi Osdobas surprise, Rabbi Schwei got more than 90% !

Now Rabbi Osdoba is claiming that if we will have an extremely poor turnout....

(Because of a Psak Din by Countless Rabbonim, that this Election is not Forbidden and simply not fair and not Kosher) - that if only 50 individual voters actually vote and 26 of these 50 Votes, are for Segal, he will proclaim him official "Rabbi", based on 26 votes!

This is what Rubashkin calls "Fair" and "Impartial Elections"?

No Rabbonim were consulted first and formost, "IF" there should be an Election, "where" or "when" or "who" etc!

For that Matter, every Tom Dick and Harry can make "New Elections for Rav", every week!

Me and You and all other residents of CH were NOT consulted either -

So, Who was it exactly, who decided, "for us" (of course it must have been "impartially decided") WHO the candidates are?

At least with Rabbi Schweis, election it had Rabbi Osdobas, 100%, full approval, BEFORE the Election, for him to even be considered to be eligible to be a Candidate - Now, it has absolutely "NO ONES" Approval!

At least with Rabbi Schweis election, we had a REAL CHOICE, if we didnt like him, we could have voted "NO" - the Choice "NO" was an actual choice on the Ballot!.

Now, Rubashkin wants to absolutely "FORCE" us to accept this, Segal Candidate, so voting "NO" (that we do "NOT" want Segal or any of these other 2) will definitely "NOT" BE AN OPTION, on Rubashkins Corrupt Ballot!

isnt it funny that ever since shwei went into the rabbins office there is such problems and foolishness coming from the most respected office in crown heights.

Subject: The importance of voting for Dayanim/Rabbonim this Sunday

As a former member of the Vaad Hakohol during the last election and as someone who cares deeply about every member of the community, I am pleading with every eligible voter to make sure you vote on Sunday.

Once upon a time Crown Heights could boast of a peerless Beis Din comprised of Dayanim who had no political or personal agenda, and whose only concern was the well-being of every man, woman and child in our shchunah whose importance extends throughout the world

Sadly, of the three gedolim who served with such seamless integrity and had the brocho of the Rebbe, only Rav Osdoba remains -- clinging steadfastly to an integrity that rises above political considerations, and serves no master but the Ribono shel Olam.

And I speak as one who suffered personally because of Rav Osdoba’s psak, but it was a psak that had no hint of corruption and no scintilla of power politics or personal gain (this is not the time to elaborate.)

Right now our community is in trouble. Our youth are confused, and more and more are going off the derech. And not just our young – entire families are adrift with nowhere to turn for guidance and help. The example being set by the current matzav in our Beis Din is causing unprecedented destruction and breakdown among our neighbors.

Sadly there are a handful of corrupt yechidim in our community who have long desired to control our Beis Din because they view it as a key to personal, political and material power. And the only way they can enjoy such power is by having their influence over Dayanim who bend to their will.

These individuals are manipulating some Rabbonim in order to derail this Sunday’s elections .

These elections offer our kehilla the potential brocho of up to three outstanding Dayanim who have vast experience and no personal agenda or interest in personal gain. Each candidate is a Rov of utmost integrity (all have already served in various functions and where called upon as needed) who can help restore to our Beis Din the shem and tiferes for which it was once justly renowned.

This election is totally consistent with the Rebbe’s goal of having “rov am” appointing the community’s Rabbonim

Our Kehilla is today blessed with a Rosh Hakohol, Moishe Rubashkin, whose every waking moment is a testament to his integrity and to his selfless concern for even (and especially) the smallest and weakest members of the Crown Heights community. While no man is perfect, surely we all recognize his unstinting acts of tzedaka and chesed. For anyone to impugn his integrity with regard to the election is to behave like Korach, except that Korach was not motivated by cynicism, greed and personal gain.

To his credit, Moishe Rubashkin has, in R. Segal, R. Raitport and R. Zirkind, assembled a slate of three outstanding, independent, experienced Rabbonim.

What’s more he has openly invited, and continues to invite, other nominees.

Those who would torpedo this election are free to list their own candidates. That they have not done so, is ample evidence of their true motives, to sow dissent and sinas chinom in order to wrest control of the Beis Din for their own underhanded and nefarious purposes.

As the Rebbe often quoted from the Slichos of Erev Rosh Hashana; “Merubim tzorchei amcha” – our community’s needs are many. These needs will only be met if an honest, diligent, capable and totally apolitical Beis Din is allowed to function without a gang of hangers-on who care only for their own kovod.

Please, please make sure you vote this Sunday.

1) By the election of rabbi shwai there had to be a 50 % turn out, so why not now? Is robashkin scared that there will be a low turn out?
2) The candidates are ALL on one side of the political map, so that side always wins! Is that election???
3) Not ALL the rabanim approved of the candidates so according to HALOCHO they can’t run!

Who created this story that the Rebbe told Rabbi Mangel not be a Ruv of Badat”z? He has been active in and sat with the Badat”z of Ch for many years on some of their hardest cases.
I suspect that that is another one of Moshe Rubaskin fabrications to justify his “private” B”D to ensure the kashrus of his families meat no matter it’s standard.

The board of Trustees of ULY were called to a din torah due to the fact that employees, mashpiyim, and melamdim are between forty - eighty weeks behind in pay. Lets go back a little. In 1999 during the weinstock case, when the teachers were 33 weeks behind the four branches of ULY decided to split and to each take on its own responsibility. Ocean Parkway and 770, due to no fault of their own, rather Ocean Parkway because of its location, and 770 because of its poor tuition income continued to fall behind an additional 30-40 weeks until today. Please note the board besides fighting Krinsky in court didnt help or offer to help with any monetary issues from when they came in until today. This excludes Mendel Drizin who has helped tremendously with money. After the Weinstock settlement, the board only paid up to 1999. Ocean Parkway and 770 who accumulated another 40-80 weeks of debt called the board to a din torah. (The board still has approximately three million dollars left from the Weinstock settlement) Many melamdim spoke with Rabbi Shwei about the upcoming din torah. Rabbi Shwei said that if they do not come to a din torah they will get a seruv. After the three hazmonos, he suddenly changed his mind and said that it is not a bais din kavua and they dont need to come to a din torah. The yeshiva is being held "hostage" up until today by the board. Over 50 of anash who work in the yeshiva are suffering from sholom bayis problems, large credit card bills, evacuations, foreclosures due to Rabbi Shweis protecting these criminals. Rabbi Osdoba has already issued a seruv against the board together with Rabbi Raitport and Rabbi Segal. The yeshiva will not give out the seruv for fear that Rabbi Shwei will counter it and say that they never had to come to a din torah. In addition, the board threatens if they give out the seruv they will close Ocean Parkway and sell the building. The only way to redeem the yeshiva is if at least two other Rabbonim are brought into the bais din. At that point, the yeshiva would feel strong enough to give out the seruv and pursue it in court if need be. Anybody who cares about Tomchei Tmimim and over 50 poor members of anash who are suffering from hunger and dire poverty due to these criminals will vote this Sunday. P.S. This is not the place to write at length about the hair raising stories of the cruelty of the board of trustees; it would take a full book to describe it.

For the sake of Sholom, can you show us a document in WRITING, that the election of Rabbi Schwei was CONDITIONAL on accepting Rabbi segal and Rabbi Reitport into the Beis Din. To my knowledge, and to the knowledge of all of my friends there ISNT such a document. As far as I know, Rabbi Osdoba (in his own handwriting), AGREED to the election of Rabbi Schwei UNCONDITIONAL (to accepting Rabbi Segal & Rabbi Reitport into th Beis Din). In the same letter, there was a REQUEST (NOT a CONDITION), to put Rabbi Segal & Rabbi Reitport as Helpers in th Beis Din.

Again: for the sake of SHOLOM, if you have proof IN WRITING, that the above was a CONDITION. please publicise it, so the record can be set straight.

we as a kehillah should do everything in our power to vote and see that our friends vote. Rabbi Schwei is a dangerous man. He is not the Aidele man he pretends to be. he is a malicious liar and pwoerhungry person. he looks out for himself and himslef only not having anyones interest in mind.

Who remembers that Rabbi mangel announced publicly that he was told by the Rebbe not to get involved in rabonus?
He said he would be moser nefesh for the klal and do it anyway because he felt it was important. When shavuos came around and he broke his leg he understood the Rebbe had meant what he said.....and he left.

According to halacha 2 rabbis who do not get along are not allowed to sit together. therefore there must either be new elections or shwei has to resign and rabbis segal reitport and zirkind will resume their positions as dayanim on din torahs without being elected by the entire comunity as they did before we got into the shwei tzarah.
If he cares about peace, why doesnt he go home? Let him tell whoever wants to hear it that the whole comunity is crazy including all the other rabbis. He will be right and we will have a normal badats!

rabbi mendel hendel and reb menachem shagalov were at a meeting with reb moishe rubashkin and rabbi plotkin

at the meeting the vaad hakahal offerd to postpone the elections for 1-2 months and agreed to get outside rabonim involved and the only condition was asked that rabbi schwei should agree and sign a letter stating that the elections will take place on a given date in a month or 2 but no later

and guess what rabbi didnt agree .

this shows that they dont want any new rabonim they just want the status quo "machloikes"
