עו"ד ציבין לתובע בבלגיה: מה עם תביעת החרדים נגד חמאס?
על רקע מתקפת הטרור בפריז: אתר וואלה והאתר ברוסית NewsRu מדווחים כי בשבוע שעבר פנה עו"ד מרדכי ציבין לתובע הפדראלי הבלגי, בבקשה לזרז מתן החלטה בתלונה נגד החמאס שהגיש בבלגיה בשם ארבעה ישראלים, תושבי אשדוד המחזיקים גם באזרחות בלגית, אשר נפגעו במהלך מבצע "עופרת יצוקה" חרדים נגד חמאס
אתר וואלה והאתר ברוסית NewsRu מדווחים כי בשבוע שעבר פנה עו"ד מרדכי ציבין לתובע הפדראלי הבלגי, בבקשה לזרז מתן החלטה בתלונה נגד החמאס שהגיש בבלגיה בשם ארבעה ישראלים, תושבי אשדוד המחזיקים גם באזרחות בלגית, אשר נפגעו במהלך מבצע "עופרת יצוקה".
עקב התלונה, שהוגשה בדצמבר 2009 ובה התבקשה משטרת בלגיה להוציא צווי מעצר נגד בכירים בחמאס, נפתחה חקירה ובמהלכה המתלוננים הגיעו לבלגיה לפי דרישת התובע ומסרו עדותם בפני שופט חוקר.
עו"ד ציבין פנה לידידו מר אדי גאסט, המילארד השוויצרי, ושכנע אותו בחשיבות הגשת התלונה, ואכן, מר גאסט הואיל לממן הוצאות הטיסה, השהייה, והוצאות נלוות אחרות, אשר נבעו עקב הנסיעה. כזכור היה זה גאסט אשר בעבר, העניק מענקים כספיים לאנשים אשר הצליחו למנוע מעשי טרור.
כמו כן הומצאו לתביעה הבלגית, על פי דרישתה, מסמכים רפואיים לביסוס התלונה. בתלונה מתבקשת משטרת בלגיה להוציא צווי מעצר בין היתר נגד איסמעיל האנייה, מוחמד דאף, חאלד משעל ועוד בכירים של החמאס. כזכור, פלסטינאים הגישו באירופה תלונות דומות נגד ציפי לבני, אלוף (מיל.) דורון אלמוג ועוד.
בפנייתו לתובע הבלגי, מדגיש עו"ד ציבין כי חלפו שש שנים מאז הגשת התלונה והטיפול בתביעה בקושי התקדם, למרות שלקוחותיו מילאו אחר כל דרישות התביעה הבלגית. ציבין מוסיף וטוען בפנייתו כי "לאור המצב המתוח בבלגיה ובצרפת עקב אירועי הטרור האחרונים באירופה, נראה כי לטובת האינטרס של לקוחותיי והאינטרס של העם הבלגי, כדאי כי מקרה זה יטופל בדחיפות. בסופו של דבר, כל פעולת טרור היא טרור, בלא קשר למקום בו בוצעה ומי ביצע. כקורבנות של טרור, לקוחותיי החליטו כי אין באפשרותם להמשיך לשתוק".
עתה לנוכח הטרור המשתולל באירופה, כתב ציבין, כי יש מקום לזרז את מתן ההחלטה בתלונה לא רק לתועלת המתלוננים, אלא גם לתועלת הציבור בבלגיה כמו גם בכל אירופה.
עו"ד ציבין אומר: "העיכוב וגרירת הרגליים בטיפול בתלונה ובמתן החלטה הוא עוול כלפי לקוחותיי ולא פחות, כלפי הציבור באירופה ובצרפת ובבלגיה בעיקר. ההתנהלות הזו היתה לרועץ וחבל, משום שהיא עשויה היתה להיות הרתעה מסויימת כלפי טרוריסטים".
ציבין היה הישראלי הראשון שהגיש תלונה לבית המשפט הפלילי הבינלאומי בהאג נגד אבו מאזן ובכירים נוספים ברשות ובחמאס. Mordechai Tzivin turned to the Belgium federal prosecutor, in a request to expedite the giving of a decision in the complaint against Hamas, which he filed in Belgium in the name of four Israelis, residents of Ashdod who also hold a Belgium citizenship, and which were hurt during Operation Cast Lead. Following the complaint, which was filed in December 2009 and in which the Belgium police was requested to issue arrest warrants against senior Hamas members, an investigation was opened, during which the complainants came to Belgium in accordance with the prosecutors' demand and gave their witness before a prosecutor judge. Likewise, in accordance with its demand, medical files were given to the Belgium prosecution for basing the complaint. Attorney Tzivin turned to his friend, Mr. Adi Gast, a Swiss billionaire, and convinced him of the importance of the complaint, and indeed, Mr. Gast financed the airfare, stay and other related expenses of the trip of the complainants to Belgium. It would be recalled that in the past Gast, gave financial grants to people who were able to prevent acts of terrorism. In the complaint, the Belgium police was requested to issue arrest warrants against, among others, Ismail Haniya, Muhamed Def, Haled Masha'l and other senior Hamas members. As remembered, Palestinians filed similar complaints in Europe against Tzipi Livni, General (in reserve), Doron Almog and others. In his request to the Belgium prosecutor, adv. Tzivin emphasized that six years have passed since the filing of the complaint and very little was done about it, even though his clients complied with all of the Belgium prosecution's demands. Tzivin adds and claims that "as the situation in Belgium & France is tense due to the recent acts of terror in Europe, it seems in the best interest of my clients as well as the Belgian people, that this case is treated with expediency. Ultimately, every act of terror equals the same terrorism, no matter where and by whom it is perpetrated. As victims of terrorism my clients have decided that they can't be silent any longer". Now, due to the raging terror in Europe, Tzivin wrote that there is place to expedite the giving of the decision regarding the complaint, not only for the benefit of the complainants but also for the benefit for the public in Belgium and in the whole of Europe. Adv. Tzivin said: “The delay and dragging feet in handling the complaint and giving a decision is an injustice towards my clients and no less towards the public in Europe and in Belgium and France in particular. This was harmful because it could have been some deterrence”. Tzivin was the first Israeli who filed a complaint to The International Criminal Court in Hague against Abu-Mazen and additional senior officials in the Palestinian Authority and Hamas."
