השאלה המשפטית העומדת בבסיס הדיון על החלטת בג"ץ עמנואל היא די מיותרת. ונניח שהוכח למעלה מכל ספק שאפליית התלמידות הספרדיות בעמנואל היה על רק עדתי טהור. כלום זה מסביר את ההיגיון שבהחלטה לנקיבת ההר בדין, דווקא בנושא זה ודווקא בנקודת זמן זו?

הדיון האמיתי צריך להתמקד במה שמכונה "השדה האנרגטי" שבו פעלו שופטי בג"ץ. מהו המנוע שפעם בקרבם שעה שהחליטו לעשות את השריר שלהם ולנצל ניצול מוגזם את כוחם כשופטים. איזו אש הוצתה במוחם כשהחליטו מה שהחליטו.

והאש היא אש זרה. היא סובלת מכמה "מחלות", הכללה, סטריאוטיפיזציה, חכמה על חלשים – אבל היא בעיקר סובלת מחוסר טעם ודעת. להלן ההסבר.

בכל משפחה יש נודניק אחד שפעם בכמה זמן פונה לילד הקטן ושואל אותו: את מי אתה יותר אוהב את אבא או את אמא? הילד מסמיק ומתבלבל, בני המשפחה נבוכים ומשתתקים ואז באה התשובה שלעולם לא תהיה מספקת. אם הוא יגיד "אותו הדבר" ידעו כולם שמישהו כבר "עבד" על זה איתו בבית, אם יגיד "את אמא" הוא ילד כן ואמיתי אבל אבא ייעלב, ואם הוא יגיד "את אבא" – תהיה מלחמת עולם.

יש שאלות שלא שואלים. נקודה. לא רק כדי להימנע מעימות ומאי נעימות, אלא, מבחינה מהותית: התשובה לשאלות אלה היא אי השאלה. פשוט לא שואלים.

אבל בג"ץ החליט אחרת. הוא החליט להציף, בחוסר טעם ודעת, את השאלה הכל כך ברורה ופשוטה: מי עומד אצלכם במקום גבוה יותר, ההלכה או חוק המדינה? כל בר דעת יודע מראש את התשובה. כל בר דעת מבין אותה ומסכים איתה. כל בר דעת יודע שזו שאלה שלא שואלים.

בכך חטא בג"ץ בחטא החמור ביותר. הוא שם עצמו מחוקק ומבצע ושופט ותליין והתערב בגסות בסדר הציבורי בשעה שאין לו לא את הכלים ולא את הסמכות לכך. חטא הטפשות, במקרים מסויימים, עולה על חטא ההפליה.

נגזר עלינו ועליהם להמשיך ולתחזק את מסלול ההתנגשויות עד ביאת גואל צדק ואזי ומלאה הארץ דעה את השם וכו'. אשר על כן, צריך לקוות ולהתפלל שבכל התנגשות עתידיות ישבו מסביב לשלחן, משני הצדדים, אנשים ברי דעת שיעזרו לצאת ממנה בשלום. לשאלה מה יהיו בעתיד יחסי בג|"ץ חרדים, התשובה, תלוי בהרכב השופטים. 

ועוד הערה אחת: בג"ץ עמנואל הוא בושה וחוצפה וטפשות והפליה – אבל אשמים אנחנו על אחינו כי ראינו צרת נפשו וכו'.  משנות החמישים ועד היום ישנה בארץ ישיבה אחת ויחידה הנקראית באופן רשמי "ישיבת תומכי תמימים לעולי רוסיה ותימן". אשרינו שזכינו לחסות בצל כנפי כ"ק אדמו"ר מליובאוויטש זי"ע שלא שם ליבו הטהור לא לעדה ולא לצבע ולא לתרבות ולא לנוסח ולא לכפתור ולא לצורה, בלתי לה' לבדו.

The legal question underlying the decision in the Emanuel petition to the High Court is of no importance. And let's assume that the discrimination of sefardi girls in Emanuel was undoubtedly proven to be based solely on ethnicity. Does that explain the logic in the decision to strictly apply the law, specifically in this matter and at this point of time?

The real debate should focus on what is called "the energetic field" in which the High Court judges act. What was their motive when deciding to put muscle and to excessively exploit their power as judges? What fire was ignited in their minds when deciding as they have decided?

And the fire is a foreign fire. It suffers from several "diseases", generalization, stereotyping - but it mainly suffers from lack of sense. Following is the explanation.

In every family there is a nagger who once in a while ask a small child: Who do you like more? Mom or Dad? The child blushes and is confused, the family is bewildered and in silence and then comes the answer which will never be satisfying. If he'll say "the same", everybody will know that someone at home "worked" on it with him; if he'll say "mom" he's a sincere child but the father will be insulted; and if he says "dad" - a world war will break out.

There are questions that should not be asked. Period. Not only to avoid confrontation and unpleasantness, but, for a substantive reason: The answer to these questions is simply not to ask them.
But the High Court of Justice decided otherwise. It decided to immerse, tastelessly, in such a simple and clear question: Who by you is above who - Halacha or State law? Anyone intelligent know the answer in advance. Anyone intelligent understands it and agrees with it. Anyone intelligent knows that this is a question not to be asked.

By that, the High Court of Justice, has sinned greatly. It put itself as a legislature, implementer, judge and hangman and rudely interfered the public order at a time when it does not have the tools or authority to do so. The sin of stupidity, in some cases, is greater than the sin of discrimination.

It was sentenced on us and them to continue and strengthen the path of confrontations ad bi'as goel tzedek and then u'mal'ah ha'aretz deah et hashem ve'chuley. Therefore, we must hope and pray that in any future confrontation, the people sitting around the table, from both sides, will be intelligent enough to help us peacefully resolve it. Regarding the future status of the relationship between the High Court of Justice and the Charedim, it depends on the panel of judges.

And one more comment: the Emanuel petition to the High Court is a disgrace and insolence and stupidity and discrimination – aval ashemim anachnu al achinu ki ra’inu tzarat nafsho ve’chuley. Since the fifties there is only a single yeshiva in Israel which is formally named “Yeshivas tomchey temimim for Russian and Yemenite immigrants”. Ashreynu that we were privileged to be sheltered under the shadow of the Lubavitcher Rebbe’s wings who did not put his holy heart not to ethnicity, not to color, not to culture, not to nusach  not to accent, not to frak, not to kapota, not to kneitch, not to button and not to shape or form, bilti Hashem levado.
